Mediation
When families separate, one of the most sensitive and emotional issues is deciding what is best for the children. Traditionally, many parents turn to the court system for help, often finding the process lengthy, costly, and stressful. Mediation is an alternative option before resorting to the court process, that puts children’s wellbeing in the centre of every conversation.
Mediation is confidential process in which a trained, neutral mediator helps parents discuss and resolve issues relating to their children. These issues may include:
- Where the children will live
- How much time they will spend with each parent
- Holiday and travel arrangements
- School choices
- Communication between parents
Unlike a judge, a mediator doesn’t make decisions. Instead, they guide the discussion so parents can reach their own agreement that suits their family’s needs. Children fare best when their parents communicate effectively, manage conflict, and
stay focused on their needs. Mediation supports this by reducing conflict, encouraging communication between parents to avoid conflict in the presence of the children, and minimising the stress and costs of court proceedings.
Mediation can involve joint mediation sessions, individual sessions and even shuttle mediation depending on the needs of the individuals. If parents are able to reach an understanding, the mediator can prepare a written summary, often called a Parenting Plan. While not legally binding, it can be converted into a Court Order, if required.
